Buck Keenan is pleased to announce another appellate victory for our client, M.A. Mills, P.C. The Fourteenth Court of Appeals has issued a substitute opinion affirming the denial of John Kotts and Bou-Matic LLC’s second motion to dismiss under the Texas Citizens Participation Act (“TCPA”). The ruling follows the Defendants’ motions for rehearing and en banc reconsideration. In its September 10 opinion, the Court reaffirmed its holding that the 2019 amendments to the TCPA apply to new claims added after the amendments’ effective date, even when the underlying lawsuit was filed earlier. The Court therefore affirmed the trial court’s denial of the TCPA motion. Congratulations to Mano DeAyala, Laura Gleen, the Buck Keenan team and our client on this latest victory.
