Strategic Litigation Ends $8M Lawsuit Victory in Rooftop Solar Dispute

Robert Paddock and Helen Hemingway McLaughlin represented a Houston company that invested over $1 million in a rooftop solar business. Despite being in default under various promissory notes and a personal guaranty, the borrower and guarantor filed a lawsuit in Harris County alleging breach of contract and fraudulent inducement.
 
The borrowers alleged that our client’s misrepresentation and breached caused them over $8,000,000 in damages. Lenders filed a counter claim against the Borrowers for breach of multiple promissory notes and breach of the personal guaranty.
 
After almost a year of complicated litigation, Borrowers dropped all claims against our client. Buck Keenan LLP developed a strategic plan to protect our client from an $8,000,000 claim. The lawsuit ended with a judgment being entered against the Borrower’s for the principal amount of the promissory notes.
