Robin Lindley and Laura Gleen secured a complete defense victory for their landlord client in a multi-million-dollar commercial property dispute in federal court this summer. A former tenant brought fraud, nuisance, and lease-based claims centered around alleged defects at a premises leased to it by Buck Keenan’s client. In a three-day bench trial, Lindley and Gleen persuaded Judge Mazzant of the Eastern District of Texas that the plaintiff’s fraud claims were time-barred, that their client had not created an intentional nuisance, that it had not constructively evicted the plaintiff, and that the lease precluded breach of warranty claims and the breach of contract damages sought by the plaintiff. The court issued a take-nothing judgment, dismissing all of the plaintiff’s claims against Buck Keenan’s client.
