Multi-Million-Dollar Verdict in Will Construction Dispute

Buck Keenan LLP partner John L. Dagley represented the independent executor of an estate in a will construction case brought by the testator’s step-children and step-grandchildren.  The dispute centered on whether an investment account worth approximately $2.5 million passed as a specific bequest under the will to the step-children and step-grandchildren or whether it passed to the testator’s nieces under the will’s residuary clause.   After a trial in Probate Court No. 1, Montgomery County, Texas, Judge Kristin Bays presiding, the court denied all relief sought by the step-children and step-grandchildren and entered a judgment in favor of Buck Keenan’s client, holding that the investment account passed under the residuary clause and assessing all costs of court against the step-children and step-grandchildren.  Mr. Dagley gives a special thanks to his co-counsel James Stilwell of Stilwell, Earl & Apostolakis LLP for his invaluable assistance in the case.
